Is “In-Perpetuity” Costing You Talent?
Have you ever requested in-perpetuity usage in a contract because it just seemed safer?
The truth is, it might be doing more harm than good. Especially when the usage doesn’t actually need to last forever.
Many talented actors decline otherwise great projects simply because the usage terms are unnecessarily overreaching. it may unintentionally narrow your talent pool. Many experienced, high-level performers understand the long-term implications of these terms and may opt out of the casting altogether. Meanwhile, those who do accept might not fully grasp what they’re signing away. This can lead to issues down the line for both the client and the talent. In the long run, fair and clearly defined usage not only protects everyone involved—it attracts top-tier talent who could be a better fit.
So… how do you know what kind of usage you really need? The following graphic can give you an idea.
Having said that, non-broadcast in-perpetuity is a smart option for internal use only, and widely accepted by professionals. It gives you flexibility without closing future doors for the talent.
